The following indictments were returned Thursday by a Do a Ana County grand jury. An indictment is only an accusation. All criminal defendants are presumed innocent until proven guilty beyond a reasonable doubt:
• Fausto Acosta, 26, 1527 Foster Drive, Apt. 26, or 311 Del Monte, Las Cruces, charged with three counts cocaine trafficking and three counts conspiracy between Sept. 16 and Sept. 22, 2010. Acosta has two prior convictions for aggravated drunken driving, according to court records.
•David Arcienega, 19, 509 Franklin, Hatch, N.M., a Hatch Valley High School student, is charged with four counts of cocaine distribution and conspiracy between Sept. 3 and Oct. 6, 2010.
•Robert Sanchez Arrieta, 51, 1135 Willow, Las Cruces, charged with five counts cocaine trafficking, five counts conspiracy and felony cocaine possession between Jan. 5 and April 7, 2010. He is currently awaiting trial on three other counts of drug trafficking and one of conspiracy, according to court records.
•Jose Banuelas, 48, 505 E. Hall, Hatch, N.M., charged with distribution of marijuana on June 23, 2010.
•William Barela, 33, 5237 Nana Trail or 5415 White Wine Road, Las Cruces, charged with tampering with public records and embezzlement on Jan. 19, 2010. The former MVD clerk's previous convictions include fraudulent use of a credit card, conspiracy and commercial gambling.
•Lauren Carbajal, 19, 2600 Idaho, Apt. 182, or 4114 Do a Ana Road, Las Cruces,
•Robert Earl Carr, 53, 100 E. Idaho or 57 Hill Top Ave., Las Cruces, charged with three counts cocaine trafficking and three counts conspiracy between Aug. 17 and Sept. 30, 2010. Carr was also recently arrested for obstruction of a criminal investigation, according to court documents.
•Felicia Chavez, 21, 45 Western Drive, Silver City, N.M., and David Saenz Palomarez Jr., 28, 201 Morrow St., Santa Clara, N.M., are charged with fraudulent use of an illegally obtained credit card (more than $500), tampering with evidence and two counts of conspiracy on Jan. 12. Palomarez is also charged with robbery. He allegedly admitted to robbing a woman outside the Mesilla Valley Mall Barnes & Noble, then purchased items at a Walmart with her credit cards. Both have prior felony burglary convictions and face mandatory time as a habitual offender, according to court documents.
•Tomas Norberto Clark, 34, 1412 Walden or 923 S. Solano, Apt. 2, Las Cruces, charged with possession of more than eight ounces of marijuana and possession of drug paraphernalia on March 12, 2010. Clark is facing mandatory time as a habitual offender, having two prior drug-related charges on his record, according to court paperwork.
•Juan Carlos Cortez, aka Miguel Angel Aguirre, 36, 437 Paloma Blanca, Chaparral, N.M., charged with two counts of criminal sexual contact of a 9-year-old girl on Dec. 27, 2010. Cortez has a prior conviction for indecency with a child in El Paso and is being held by Immigration & Customs Enforcement.
•Annette Escalera, 19, 1900 N. Solano, Apt. 124, Las Cruces, charged with larceny (more than $500) and conspiracy on Jan. 16. Escalera allegedly admitted to stealing pecans.
•Ricardo Esparza, 19, 1751 W. Hadley #220, Las Cruces, charged with false imprisonment and battery on Dec. 23, 2010. Esparza allegedly pushed the victim to the ground and held him while trying to get information about a burglary at his girlfriend's home, according to court documents.
•Teresa Hernandez, who also uses the last names Flores, Andzelir, Duran, Garcia, Grasham and Kramer, 51, 505 W. Griggs #C, charged with cocaine trafficking on March 17, 2010. Hernandez has a prior drug conviction and is facing mandatory time as a habitual offender, according to court documents.
•Bobby Joe Marquez, a.k.a. Bobby Jose Abbott, 48, 308 San Benito St., Berino, N.M., or 633 E. Berino Road, Mesquite, N.M., charged with breaking and entering, two counts of criminal property damage and resisting arrest on Jan. 18. Marquez allegedly broke into a business and tried to break into an ATM machine with a shovel and faces mandatory time as a habitual offender, according to court documents.
•Marcella Mu oz, 36, 9617 El Centro, Las Cruces, charged with cocaine trafficking and conspiracy on Sept. 24, 2010. Mu oz has been convicted of two previous drug crimes and faces mandatory time as a habitual offender, according to court records.
•Georgette Nevarez, 20, 131 Lomas, Mesquite, N.M., charged with aggravated assault against a household member with a deadly weapon (a butcher knife) and battery against a household member on Jan. 14. Nevarez was convicted twice of aggravated assault against a household member with a deadly weapon and she awaits trial in a battery against her mother, who was also the victim in this case, according to court records.
•Matthew R. Ortega, 34, 3900 Elks or 1655 Wooten, Las Cruces, charged with forging a letter from the city of Las Cruces on Nov. 18, 2010. Ortega allegedly forged the document to get an extension on his rent, according to court documents.
•Emilio G. Perea, 61, 60160 N.M. 28, La Mesa, N.M., charged with felony cocaine possession, possession of drug paraphernalia, drunken driving and turning without a signal on Dec. 3, 2010.
•Gary Oliver Roybal, a.k.a. George Aragon, 46, 1214 S. Solano, Apt. 4, or 1169 Douglas St., Las Cruces, charged with cocaine trafficking and conspiracy on March 9, 2010. Roybal faces mandatory time as a habitual offender, according to court paperwork.
•James Manuel Saiz, 52, 1120 E. Mountain, Las Cruces, charged with four counts of heroin trafficking (second offense) and conspiracy between Sept. 22 and 29, 2010. Saiz has a previous conviction for drug trafficking in Las Cruces and is facing mandatory time if convicted, according to court documents.
•Christopher Serafin, 28, 1916 Darlene Drive, Las Cruces, charged with negligent child abuse, drunken driving and careless driving on Dec. 12, 2010. Serafin allegedly admitted to drinking alcohol and driving with his 1-year-old in the vehicle, and had a .12 BAC, according to court documents.
•Lacey Sullivan, 20, 112 W. Georgia, Anadarato, Okla., charged with two counts of battery on a health-care worker on Jan. 13 at Mesilla Valley Hospital.
•Kipp William Wilson, 48, 1071 9th St., Las Cruces, charged with fraud (more than $500) and conspiracy on Dec. 15, 2010. The two allegedly returned merchandise to Kohl's they had not purchased. Wilson faces mandatory time as a habitual offender, according to court paperwork.
