LAS CRUCES - You know what they say: When the only tool you have is a shovel, everything looks like an ... ATM?

Perhaps that was the case for 48-year-old Bobby J. Marquez of Berino, who was jailed Tuesday night after the Do-a Ana Sheriff's Office claims he tried to break into a Bank of the West ATM, and then a neighboring business, with a shovel.

Deputies were dispatched to an alarm at the 300 block of Anthony Drive in Anthony, but found no one at the ATM.

While examining the scene, however, another deputy discovered a man breaking into an office nearby, on Lincoln. After a short foot pursuit, deputies apprehended Marquez. The FBI, which responded initially to the bank call, turned over the scene to sheriff's investigators.

Marquez was arrested and charged with breaking and entering, causing more than $1,000 in property damage, simple property damage and evading an officer.
