The following indictments were returned Thursday by a Doña Ana County grand jury. An indictment is only an accusation. All criminal defendants are presumed innocent until proven guilty beyond a reasonable doubt:
•Andres Acosta, 47, 125 or 925 Poplar, Las Cruces, charged with aggravated drunken driving (four prior convictions, another pending), speeding, driving with a suspended license, negligent use of a deadly weapon (by intoxication) and possession of an open container of alcohol in a vehicle on Nov. 24, 2010.
•Jose Antonio Deleon Aleman, 35, 660 Guillen, Berino, charged with felony cocaine possession on Feb. 5.
•Mario Angel Tarin Balderas, 27, 1020 La Pampa, Juárez, Mexico, charged with marijuana distribution (50 pounds) on Feb. 5. He is being held by Immigration and Customs Enforcement.
•Jose Alberto Baylon, 25, 1105 Calle del Sol or 125 Calle de las Flores or 429 Dartmouth Apt. D, Las Cruces, charged with aggravated drunken driving (three prior convictions), driving with a suspended license, concealing identity, careless driving and possession of an open container of alcohol in a vehicle on Nov. 13, 2010. Baylon was allegedly involved in a crash and found by police passed out at his wheel with the vehicle still in drive, according to court documents.
•Victor D. Baylon, 29, 1635 Wyoming, Las Cruces, or 200 Moonlight Road, La Mesa, charged with aggravated drunken driving (three prior convictions) , negligent child
• John Edmund Bone Jr., 47, 30505 N.M. 185, Hatch, charged with aggravated drunken driving (three prior convictions), driving with a suspended license, possession of an open container of alcohol in a vehicle, leaving the scene of a car crash with property damage, failure to immediately notify authorities of an accident, no insurance and expired registration on Nov. 12, 2010. Bone allegedly drank a 40-ounce beer, crashed into a school bus and fled the scene, according to court documents.
•Julio Cesar Banda Chavez, 21, 845 Watson Lane or 5427 Enterprise, Space A, Las Cruces, charged with armed robbery (firearm enhancement) and theft of two 18-packs of beer from a Pic Quik on Aug. 19, 2008. An admitted gang member who has pending other violent criminal charges, Chavez allegedly threatened two clerks with a handgun and also stole cash.
•Javier Garjeda Gonzales, 43, 1821 Missouri, Las Cruces, charged with aggravated drunken driving (five prior convictions) and driving with a suspended license on Dec. 26, 2010.
•Derek Gonzalez, 26, 824 N. Armijo, Las Cruces, charged with 14 counts of acquisition of Oxycodone by forged prescription between July 6 and Oct. 11, 2010.
•Lisa Holguin, 19, 900 E. Madrid #29, Las Cruces, charged with check forgery on Aug. 26, 2010.
• Elson John Honnie, 29, 1219 N. El Paso, Las Cruces, charged with drunken driving (four prior convictions), driving with a suspended license, failing to yield the right of way to an emergency vehicle, failure to maintain a traffic lane and possession of an open container of alcohol in a vehicle on Dec. 2, 2010.
•Efren Sianes Manjarrez, 55, 807 N. 17th St., Apt. 152, or 1907 W. Picacho Ave., Apt. 12, and Jesus Alviso Rodriguez, 58, 280 17th St., Apt. 8, Las Cruces, both charged with unlawful taking of a motor vehicle and conspiracy to do so on Feb. 1. It is Rodriguez's second time being charged with such an offense, according to court documents.
•Alfredo Montoya, 24, 9775 Luna Vista Trail, Space 1, or 5475 Porter, Space 58, Las Cruces, charged with possession of a firearm (a shotgun) by a felon on Jan. 15. Montoya was convicted of kidnapping and robbery in a 2007 case.
•Henry Morones, 33, 16370 N.M. 28, Las Cruces, charged with felony cocaine possession, giving alcohol to a minor and possession of drug paraphernalia on Jan. 16. One of his parents asked police to remove Morones from the home for his activities, according to court documents.
•Mario Martinez Ovalle, 22, 451 Roadrunner, Apt. 803, Las Cruces, charged with eight counts of marijuana distribution, four counts of trafficking, one count of possession with intent to distribute and one count of possession of drug paraphernalia between Sept. 7 and Dec. 8, 2010.
•Alfredo Ramirez, 44, 10931 Oden Drive, El Paso, charged with 10 counts of forging a signature between July 18, 2006, and Aug. 23, 2010. Ramirez has an extensive criminal history including convictions for trafficking cocaine, drunken driving and cruelty to animals, according to court records.
•Freddy N. Vasquez, 40, 5255 Pueblo Trail, Las Cruces, charged with aggravated drunken driving (three prior convictions since 2008), driving with a suspended license, resisting arrest and possession of an open container of alcohol in a vehicle on Nov. 28, 2010.
•Johnathan C. Walker, 24, 320 E. Union, Apt. 913, Las Cruces, charged with three counts of acquiring drugs by misrepresentation on Nov. 10 and 29 and Dec. 17, 2010. Walker allegedly used his position at a doctor's office to obtain Hydrocodone with forged prescriptions, according to court documents.
