LAS CRUCES - A gang member who committed a drive-by shooting while awaiting trial for a criminal property damage charge will serve no extra time in prison for the drive-by.
Daniel Torres, now 20, was sentenced to 18 months in prison, which will be served concurrently with his sentence for causing almost $3,300 in property damage in 2009, according to Judge Stephen Bridgforth's judgment, filed last week in 3rd Judicial District Court.
He will also serve one year parole and pay $110 in fines.
Torres, who goes by the name "Listo," which means "ready," was convicted Nov. 1 of shooting at an occupied building and conspiracy, and could have received three additional years in prison for the two felonies.
Fellow gang-member Orlando Bustillos, also 19, received a one-year prison sentence with two years to be served on supervised probation, according to the district attorney's office, which confirmed both defendants' gang affiliations.
The pair was arrested April 21 after shooting about a dozen rounds from a Springfield XD handgun at an occupied home from a white Pontiac Grand Am near the intersection of Idaho Avenue and Locust Street in central Las Cruces, according to Las Cruces Police Department spokesman Dan Trujillo.
No injuries were reported, but a home and a Ford pickup truck received several bullet holes and 11 casings were recovered at the scene.
The handgun was recovered from the Pontiac.
Torres spent eight days in jail before being released on bond.
At the time of their arrests, Bustillos was on probation after a conviction of possession of alcohol by a minor last October and had a warrant out for his arrest for failure to appear in court on a charge of driving without a license, according to court records.
