LAS CRUCES - A state District Court hearing on a tax lightning lawsuit filed against the Do a Ana County Assessor's Office will be at 9 a.m. today at the Do a Ana County Judicial Complex, 202 W. Picacho Ave.

William and Martha Beerman have filed a legal challenge to the amount of assessed property taxes that have been levied against their east Las Cruces home. The lawsuit is the first of its kind in Do a Ana County.

District Judge Manny Arrieta will preside at today's hearing.

Two state District Court judges in Bernalillo County have ruled that state law that authorizes the additional property tax to be assessed is unconstitutional. Those decisions have been appealed to the New Mexico Court of Appeals.

The Beermans are seeking a summary judgment.
